TERMS OF SERVICE.

1. Introduction Welcome to the Australian Veteran Centre (AVC). By engaging our services to assist with your Department of Veterans’ Affairs (DVA) claims, you agree to the following terms and conditions.

2. Nature of Services AVC provides professional advocacy services to assist veterans in navigating DVA legislation (MRCA, DRCA, VEA).

  • We are Advocates, Not Lawyers: While we have extensive experience with DVA legislation, our services constitute veteran advocacy, not legal advice.

  • No Guarantee of Outcome: The final decision on any claim rests solely with the DVA. AVC cannot and does not guarantee a specific financial outcome or claim acceptance. We guarantee only to prepare and manage your case to the highest professional standard.

3. Client Responsibilities To ensure the best chance of success, you agree to:

  • Honesty: Provide truthful, accurate, and complete information regarding your service, medical history, and incidents. AVC reserves the right to terminate services immediately if a client knowingly provides false or misleading information to us or the DVA.

  • Responsiveness: Respond to requests for information or documents in a timely manner. Delays in providing information may delay your claim.

  • Medical Appointments: Attend all medical appointments arranged by AVC or the DVA. Failure to attend may result in DVA rejecting your claim.

4. Fees and Payment

  • Our fee structure will be provided to you in a separate Service Agreement prior to the commencement of work.

  • By engaging us, you agree to the payment terms outlined in that specific agreement.

  • AVC prides itself on ethical pricing. We do not hide costs.

5. Confidentiality AVC agrees to keep all client dealings confidential. We will not disclose your details to third parties without your consent, except as required to process your claim (e.g., speaking to DVA) or by law.

6. Limitation of Liability To the extent permitted by Australian law, AVC is not liable for:

  • Delays caused by the DVA or external medical providers.

  • Rejection of claims by the DVA.

  • Any indirect or consequential loss arising from the use of our services.

7. Termination of Service

  • By You: You may terminate our engagement at any time by providing written notice.

  • By Us: AVC reserves the right to withdraw services if a client is abusive to staff, requests unethical action, or fails to pay agreed fees.
